Drunk Driving Increases During the Holidays

Drunk Driving Increases During the Holidays

If you don’t want to spend 2026 having to take a breath test every time you start your car, don’t drink and drive. Arizona is a zero-tolerance state, and with the holidays approaching, law enforcement is gearing up for an increase in drunk driving incidents.

Every year, the holidays account for a significant number of the arrests for DUIs. If you get caught driving under the influence, you could end up with a suspended license, a jail sentence, fines, and more. Here’s what a DUI conviction means in Arizona, and why you’ll need a good lawyer.

DUIs Have a Range of Consequences

Besides a criminal record, the penalties for a DUI conviction may include:

  • Jail or prison time
  • Fines, fees, or restitution
  • Probation
  • Suspension of driver’s license
  • Mandatory interlock device (breathalyzer)
  • Completion of a substance abuse program

Anyone Can Get Pulled Over

Most people get in trouble by asking themselves, “How will the cops even know?” and then getting behind the wheel anyway. But there are many reasons the police can pull you over.  For instance, you could be driving normally but have a taillight out. Or you might encounter a roadblock and have to take a breath test to pass.

Here are some of the reasons you can get pulled over:

Reckless Driving

Alcohol and drugs can impair your ability to safely manage the vehicle, which slows your reaction time and makes your driving more reckless.

Concerned Witnesses

Sometimes law enforcement receives reports from others who are concerned for your wellbeing or that of others.

Minor Traffic Violations

An officer might notice mannerisms during routine stops that point to intoxication or impairment.

DUI Checkpoints

Typically set up in crowded areas, DUI checkpoints are law enforcement’s way of keeping impaired drivers off the road.

What Happens If You Refuse a Breath Test?

Arizona has “implied consent to test” laws. If you get behind the wheel of a vehicle, you are agreeing to comply with law enforcement, including any requests to be checked for drugs or alcohol in your system. You do have the right to refuse a breath test. However, a refusal could mean the loss of your licence, jail time, and harsher sentencing if you are found guilty of driving under the influence.
