Understanding Arizona Felony Classes

What is the difference between a Class 1 and Class 6 felony? Or between a felony and a misdemeanor? In this post we explain the differences between each of the felony classes in Arizona, along with the penalties related to each level of crime. 

Felonies vs. Misdemeanors

Each state has different classifications and penalties for felonies and misdemeanors. In Arizona, misdemeanors are typically lighter crimes, with punishments typically ranging from a couple of months in jail to fines and community service. Felonies are more serious crimes, and felony convictions carry a set amount of jail time, along with fines or fees.

Why Does A Class 1 Felony Look Different in Arizona?

Class 1 felonies are the only type of felony conviction that depends solely on the judgment of the court. First-degree and second-degree murder are the only class 1 felonies. Depending on the specifics of the crime, the terms of punishment can range from several months of prison time and a fine, to a lifetime prison sentence. 

In Arizona, there are three types of lifetime sentences: 

  1. Imprisonment for Life: Allows the possibility of parole after 25 years if the victim was over the age of 15, and after 35 years if the victim was under the age of 15.
  2. Imprisonment for Natural Life: The prisoner is not eligible for parole or for several other programs available to other prisoners.
  3. Death Penalty: The prisoner is allowed no parole, however, they may appeal for a lesser sentence of life in prison.
