03 May Defenses Against DUI: Part 1
It is important to understand that there are many ways in which to defend against DUI charges. There are a number of constitutional and statutory challenges that DUI defense attorney Todd Coolidge looks for when he prepares a DUI case.
Arizona DUI Law
Arizona’s DUI law indicates that it is illegal to drive with an illegal alcohol concentration or with drugs in a person’s body within 2 hours of driving which means that officers are going to try and get a chemical test within that 2-hour window. If the officer fails to do so, the State will have to bring in an expert witness to indicate that the alcohol concentration would still have been above the legal limit within that 2-hour window. That expert would have to testify to a retrograde extrapolation.
This retrograde extrapolation is based on a person’s time of driving, time of chemical test, drinking history, and a number of other factors. This is usually based on the expert making a number of assumptions about the person charged with DUI. If the State has not proved the results beyond a reasonable doubt, this retrograde extrapolation can be called into question and the chemical results possibly suppressed. In an impairment case, this can also be used in order to prove someone is below the legal limit at the time of driving.
