Domestic Violence Has Serious Consequences in Arizona

Domestic violence can be any type of violent or threatening behavior that is committed against another member of the same family or household. Because domestic violence is an aggravating factor, these crimes have very serious consequences. A crime that might normally be a misdemeanor could end up being charged as a felony instead. Here’s what domestic violence means in Arizona.

Domestic Violence Is an Aggravating Factor

In Arizona, classifiers like domestic violence will change the severity of the charges. Because domestic violence is an aggravating factor, this means that incarceration times are longer, fines are higher, and there may be additional penalties.

For example:

Hitting a stranger would be considered assault. But hitting a family member would mean an assault charge along with charges of domestic violence

There are additional consequences for domestic violence, such as:

  • An additional year over the maximum incarceration time
  • No chance of having the charges set aside or expunged
  • Completing (and paying for) an accredited domestic violence offender treatment program
  • Additional fines and/or restitution

Aggravated Domestic Violence Has Even Harsher Consequences

If there has been more than one domestic violence conviction within 7 years, or there are other aggravating factors, the charges are even more severe.

Additional consequences for aggravated domestic violence may include:

  • Incarceration for an additional 4 months for two prior convictions, and 8 months for three or more
  • An additional 2 years incarceration time if the victim was pregnant
  • Ineligibility for parole, pardon, or suspension of sentence
